Former President Luiz Inácio Lula da Silva’s defense today (02/20) filed, electronically, the so-called “motion for clarification” against the appellate decision rendered by the 8th Panel of the Regional Federal Court of the 4th Region (TRF4) concerning Criminal Appeal no. 5046512-94.2016.4.04.7000.
The document demonstrates that the said appellate decision has 38 omissions regarding elements in the proceeding that were brought up by the defense when they filed the criminal appeal. It also points out 16 contradictions among its own terms, besides 5 unclear points. In other words, some aspects of the judgment are difficult to understand.
The defense requests that the correction of such omissions, contradictions, and unclear points change the decision concerning the appeal tried on 01/24 (“modificatory character”), and also requests that the whole procedure be nulled and void and Lula acquitted.
The 8th Panel of TRF4 shall decide on the motion for clarification, on a date yet to be set.
