As attorneys of former President Luiz Inácio Lula da Silva, we filed today (01.12.2017) a lawsuit for non-material damages against the State Prosecutor Cassio Roberto Conserino from the State Attorney’s Office of São Paulo.

The lawsuit may be assigned to one of the Civil Courts of São Bernardo do Campo, where Lula lives, and it requests that Conserino be sentenced to pay 1 million BRL as indemnity to former President Lula, taking into account the range of the non-material loss caused, and also the economic-financial capacity of the aforementioned public official.

The following was demonstrated in the lawsuit: (i) the defendant’s use of prerogatives and his position as State Prosecutor to perform acts of defamation (criminal offense); (ii) the defendant’s wrongful conduct in the exercise of his functions, which was confirmed by two subsequent facts: (a) the discontinuance of the lawsuit against Lula (claiming “personal matters”), after the court system decided that former President Lula was not within his scope of jurisdiction and also, (b) the sharing of a clearly offensive picture regarding the former President as a “fools charmer” on his Facebook account.

On November 9th, the Federal Attorney’s National Council instituted a Disciplinary Punishment against the Prosecutor, accepting the request we have made regarding some of the very same facts presented in the lawsuit filed today.
